Your privacy matters to us. This policy explains how we collect, use, and protect your information.

Forever Memories ("we," "us," or "our") operates the Forever Memories website and memorial platform. This Privacy Policy describes how we collect, use, store, and share your personal information when you use our website, create or visit memorials, purchase products, or interact with our services.

By using our services, you agree to the collection and use of information as described in this policy. If you do not agree, please do not use our services.

When you create an account, purchase a memorial, or use our services, we may collect:

  • Account Information: Name, email address, and password when you register
  • Memorial Content: Names, dates, biographical information, photos, and other content you upload to memorial pages
  • Payment Information: Billing name, address, and payment details when you make a purchase (payment processing is handled securely by our third-party payment processor)
  • Guestbook Entries: Name, email address, and messages left on memorial guestbooks
  • Collaborator Information: Email addresses of people you invite to collaborate on a memorial
  • Communications: Any messages or information you send to us through our contact form or email

Information Collected Automatically

When you visit our website, we may automatically collect:

  • Usage Data: Pages visited, time spent on pages, links clicked, and other browsing activity
  • Device Information: Browser type, operating system, device type, and screen resolution
  • IP Address: Used for security purposes, spam prevention, and approximate geographic location
  • Cookies: Small files stored on your device to maintain your session, remember preferences, and improve your experience

2. How We Use Your Information

We use the information we collect to:

  • Provide Our Services: Create and maintain memorial pages, process purchases, and deliver QR memorial plaques
  • Manage Accounts: Authenticate users, manage collaborator access, and maintain account security
  • Process Payments: Complete transactions and send purchase confirmations
  • Communicate: Send guestbook notifications, weekly memorial summaries (if opted in), and respond to your inquiries
  • Improve Our Platform: Analyze usage patterns to enhance features, fix issues, and develop new services
  • Ensure Security: Detect and prevent spam, fraud, abuse, and unauthorized access
  • Comply with Law: Meet legal obligations and enforce our terms of service

3. How We Share Your Information

We do not sell your personal information. We may share your information only in the following circumstances:

  • Public Memorial Content: Memorial pages set to "public" are visible to anyone on the internet, including search engines. Unlisted memorials are only accessible via direct link or QR code and are excluded from search engines and our Wall of Tributes
  • Collaborators: If you are invited as a collaborator on a memorial, the memorial owner can see your email address and the content you contribute
  • Payment Processors: We share necessary billing information with our payment processor (WooCommerce/Stripe) to complete transactions. We do not store your full credit card number
  • Service Providers: We may use third-party services for hosting, email delivery, PDF generation, and analytics. These providers only access information necessary to perform their services and are bound by their own privacy policies
  • Legal Requirements: We may disclose information if required by law, court order, or government request, or to protect the rights, safety, or property of Forever Memories, our users, or the public

4. Memorial Content & Visibility

Memorial pages are at the heart of our service. Here's how visibility works:

  • Public Memorials: Visible to anyone, listed on our Wall of Tributes, included in search engine results and our sitemap
  • Unlisted Memorials: Only accessible via direct link or QR code. They are excluded from the Wall of Tributes, site search, sitemaps, and are marked as "noindex" to discourage search engine indexing
  • Content Ownership: You retain ownership of all content you upload. By posting content on a public memorial, you grant us a license to display that content as part of the memorial page
  • Guestbook Entries: Guestbook comments are visible on the memorial page. Memorial owners can moderate guestbook entries. Users can flag inappropriate comments for review

If you need a memorial removed, contact us and we will assist you promptly.

5. Cookies & Tracking

We use cookies and similar technologies for the following purposes:

  • Essential Cookies: Required for basic site functionality, including login sessions, form submissions, and security (nonce validation)
  • Collaborator Access Cookies: Used to verify collaborator permissions when accessing memorials they've been invited to edit
  • Analytics Cookies: Help us understand how visitors use our site so we can improve the experience
  • Preference Cookies: Remember your settings and choices across visits

You can control cookies through your browser settings. Disabling essential cookies may prevent some features from working properly.

6. Data Security

We take the security of your information seriously and implement measures including:

  • SSL/TLS encryption for all data transmitted between your browser and our servers
  • Secure password hashing for user accounts
  • Nonce validation and capability checks on all write actions
  • Input sanitization and XSS protection across all forms and AJAX endpoints
  • Rate limiting and spam protection (including reCAPTCHA) on public-facing forms
  • Restricted file upload types and sizes
  • Regular backups of memorial data

While we strive to protect your information, no method of transmission or storage is 100% secure. We cannot guarantee absolute security but are committed to maintaining industry-standard protections.

7. Data Retention

  • Memorial Content: Memorials are intended to be permanent. We retain memorial content indefinitely unless the owner requests deletion or the memorial is removed for policy violations
  • Account Information: Retained as long as your account is active. If you request account deletion, we will remove your personal information within 30 days, except where required by law
  • Guestbook Entries: Retained as part of the memorial unless removed by the memorial owner or flagged and removed by our moderation team
  • Payment Records: Retained as required for accounting, tax, and legal compliance purposes
